Waiver and Release of Liability

This Waiver and Release of Liability (“Agreement”) is entered into by the participating individual (“Customer”) and the following entities:

• NJ Footy LLC, a New Jersey limited liability company, doing business as NJ Footy

• NYC Footy Corp, a New York corporation, doing business as NYC Footy

These entities are collectively referred to throughout this Agreement as the “Companies” or “Released Parties.”

I understand, acknowledge, and agree with the following:

Participating in any athletic event is an extreme test of a person's physical and mental limits and carries with it the potential for death, serious injury and property loss. The risks include, but are not limited to, those caused by terrain, facilities, temperature, weather, condition of athletes, equipment, vehicular traffic, actions of other people including but not limited to, participants, volunteers, spectators, referees, league organizers, and lack of hydration.

I agree to comply with all rules and regulations for participation in Released Parties' soccer programs. I agree to inspect the equipment and premises to be used prior to participation and if I believe that anything is unsafe, I will inform league officials, team captains, referees of the issue and refuse to participate if not corrected.

I understand that soccer can be played in varying weather conditions, including rain, snow, extreme cold or extreme heat. I understand that certain seasons are prone to particular weather patterns (extreme heat in the summer, snow and extreme cold in the winter) and I accept that by registering for a league, I am agreeing to play in conditions consistent with that season (e.g. snow during outdoor winter soccer).

I hereby assume all of the risks of participating in Released Partiessoccer's programs. I realize that liability may arise from negligence or carelessness on the part of the persons or entities being released, from dangerous or defective equipment or property owned, maintained or controlled by them or because of their possible liability without fault.

I certify that I am physically fit, have sufficiently trained for participation in the event and have not been advised otherwise by a qualified medical person that I cannot participate. I acknowledge that this Accident Waiver and Release of Liability form will be used by Released Parties in events in which I may participate and that it will govern my actions and responsibilities at said events.

In consideration of my application and permitting me to participate in this event, I hereby take action for myself, my executors, administrators, heirs, next of kin, successors, and assigns as follows:

Waive, release and discharge from any and all liability for my death, disability, personal injury, property damage, property theft or actions of any kind which may hereafter accrue to me or my traveling to and from this event, the organizer and the following entities or persons: Their directors, officers, employees, volunteers, representatives, and agents, the event holders, event sponsors, event directors, event volunteers, and event officials.

Indemnify and hold harmless the entities or persons mentioned in this paragraph from any and all liabilities or claims made by other individuals or entities as a result of my or any actions during this event.

I am voluntarily participating in a Released PartiesSoccer program. I hereby consent to receive medical treatment, which may be deemed advisable in the event of injury, accident and/or illness during the league. The Accident Waiver and Release of Liability shall be construed broadly to provide a release and waiver to the maximum extent permissible under applicable law.
